Defending the person accused

According to part 2 of Article 42 of the Criminal Code of Ukraine, the accused (defendant) is a person whose indictment has been transferred to court in the manner prescribed by Article 291 of this Code.

According to paragraph 1 of Article 45 of the Criminal Code of Ukraine, the defender is a lawyer who defends the suspect.
According to Article 47 of the Criminal Code of Ukraine:
- The defender shall be obliged to use the means of defense stipulated by this Code and other laws of Ukraine to ensure respect for the rights, freedoms and legitimate interests of the suspect, the accused and to clarify the circumstances that refute the suspicion or accusation, mitigate or eliminate the criminal responsibility of the suspect, the accused.
- The defense counsel shall arrive to participate in the performance of procedural actions involving the suspect, the accused. In case of inability to arrive at the appointed time, the defense counsel shall notify in advance such inability and its reasons to the investigator, prosecutor, investigating judge, court, and if appointed by the body (institution) authorized by law to provide free legal assistance – also that body (institution).
- The defender shall not have the right, without the consent of the suspect or the accused, to disclose information that has become known to him in connection with his participation in criminal proceedings and constitutes attorney-client privilege or other secrets protected by law.
According to Part 1 of Article 48 of the Criminal Code of Ukraine, the defense counsel may at any time be involved by the suspect, the accused, their legal representatives, as well as other persons at the request or consent of the suspect, the accused to participate in criminal proceedings. The investigator, prosecutor, investigative judge, and court are obliged to provide the detainee or person in custody with assistance in establishing communication with a defender or persons who may invite a defender, as well as to provide an opportunity to use means of communication to invite a defender.The investigator, prosecutor, investigative judge, and court are obliged to refrain from providing recommendations on engaging a particular defender.
