The lawyer for housing disputes (cases): professional assistance in Kyiv<\/h2>\n

Despite the changes and additions, this Code does not meet the requirements of the present one, and along with other old codes (the Labor Code, the Code of Administrative Offenses) is a vestige of the Soviet legal system. What is meant?<\/p>\n

On May 06, 1993 the process of citizens acquiring the residential premises they occupied into private ownership started in Ukraine (Article 65-1 of the Housing Code of the Ukrainian Soviet Socialist Republic). On June 28, 1996 the Constitution of Ukraine was adopted. On January 01, 2004 the Civil Code of Ukraine entered into force. According to Article 4 of the Civil Code: 1. The basis of the civil legislation of Ukraine is the Constitution of Ukraine; 2. The main act of the civil legislation of Ukraine is the Civil Code of Ukraine.<\/p>\n

One of the main legal conditions of social and economic development today is the right of ownership and other proprietary rights (Book III of the Civil Code of Ukraine), while the Housing Code of the RSFSR regulates housing relations related to the state and public housing stock, which becomes less and less, and lags behind regulates housing relations related to private housing stock, which becomes more and more, but the rules of the Housing Code of the Ukrainian Soviet Socialist Republic are still in force and the courts apply them.<\/p>\n

This is, in my opinion, a vivid example of a normative limitation of the right to property.<\/p>\n

According to sentence 2 of part 4 of article 156 of the Housing Code of the Ukrainian Soviet Socialist Republic, the termination of a family relationship with the owner of a house (apartment) does not deprive them of the right to use the premises they occupy.<\/p>\n

This norm of the Housing Code of the Ukrainian Soviet Socialist Republic (hereinafter – the Housing Code) deprives the owner of the house (apartment) of the possibility to evict a former family member (former husband, wife) from the occupied premises. In other words, a former family member can continue to live (possibly annoy you) essentially for life.<\/p>\n

Grounds and procedure for eviction from residential premises in Ukraine<\/h2>\n

According to Part 1 of Article 109 of the Housing Code, eviction from occupied housing is allowed on grounds established by law. Eviction is carried out voluntarily or by court order.<\/p>\n

    \n
  • Private housing stock.<\/li>\n<\/ul>\n

    According to Article 157 of the Housing Code, family members of the owner of a house (apartment) can be evicted in cases stipulated by part one of Article 116 of this Code. The eviction is carried out in a court order without providing other living quarters.<\/p>\n

    According to Part 1, Article 116 of the Housing Code, if the tenant, his family members or other persons living with him, systematically destroy or damage the premises, or use them not for their intended purpose, or by systematically violating the rules of social cohabitation make it impossible for others to live with them in the same apartment or house, and prevention and social influence measures have been ineffective, the eviction of the guilty at the request of the lessor or other interested persons is carried out without providing other living quarters.<\/p>\n

    The claim for eviction without providing other accommodation must be based on the circumstances referred to in paragraph 1 of Article 116 of the Housing Code, and contain evidence of each such circumstance, otherwise the court will deny the claim.<\/p>\n

      \n
    • State and public housing stock.<\/li>\n<\/ul>\n

      According to Article 124 of the Housing Code, workers and employees who terminated labor relations with an enterprise, institution, organization, as well as citizens expelled from members of the collective farm or who left the collective farm at their own will are subject to eviction from the service housing with all living persons, without providing other living quarters.<\/p>\n

      According to Article 132 of the Housing Code:<\/p>\n

      Seasonal, temporary workers and persons who worked under a fixed-term labor contract, who terminated their employment, as well as persons who studied in educational institutions and left them, are subject to eviction without providing other living quarters from the dormitory that they were provided in connection with their work or study.<\/p>\n

      Other employees of enterprises, institutions, organizations, who have settled in a dormitory in connection with their work, may be evicted without the provision of other living quarters in the case of dismissal at will without good cause, for violation of labor discipline or committing a crime.<\/p>\n

      Thus, both the client and the lawyer for housing disputes (cases) need to be extremely careful with the grounds that rely on the claim and the evidence with which they are substantiated.[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"
