The main subject of interaction on inheritance is a notary (public or private). Ukraine is moving toward simplification and accessibility of the inheritance procedure, as I noted in the news of January 24, 2017.<\/p>\n<p>Assistance of a lawyer in obtaining an inheritance in Kyiv and Ukraine will be needed when the general (notarial) order of acceptance and registration of the inheritance went wrong. header_2_font_size_last_edited=&#8221;on|phone&#8221; header_3_font_size_tablet=&#8221;&#8221; header_3_font_size_phone=&#8221;24px&#8221; header_3_font_size_last_edited=&#8221;on|phone&#8221;]<\/p>\n<ul>\n<li>recognition of the will as invalid (part 2 of article 1223, 1257 of the Civil Code),<\/li>\n<li>to dismiss the right to inheritance ( article 1224 of the Civil Code),<\/li>\n<li>reduction of the amount of the mandatory inheritance share (paragraph 1 of article 1241 of the Civil Code),<\/li>\n<li>determination of the additional term for acceptance of the inheritance (part 3 of article 1272 of the Civil Code),<\/li>\n<li>recognition of ownership rights in the order of inheritance according to the law,<\/li>\n<li>recognition of the invalidity of the certificate on the right to inheritance (part 1 of article 1301 of the Civil Code),<\/li>\n<li>on compensation of reasonable expenses made by a person for maintenance, care, treatment and burial of the testator (article 1232 of the Civil Code),<\/li>\n<li>and others.<\/li>\n<\/ul>\n<p>Important evidence in this category of cases is the materials of the inheritance file, which, as a rule, at the request of the parties, are demanded from the notary by court order.<\/p>\n<p>Courts pay attention to why the plaintiff (applicant) immediately applied for protection of his legal rights and interests in court, maybe he had all the conditions to exercise his rights and interests in a notarial procedure.<\/p>\n<p>Each type of claims has its own peculiarities, but with the presence of grounds, qualitatively compiled claim (application) and following the procedure, they with high probability will be satisfied by the courts.<\/p>\n<p>For yourself it is necessary to know that inheritance is the transition of the rights and obligations (inheritance) from the deceased (testator) of a physical person to other persons (heirs) (part 1 of article 1216 of the Civil Code).<\/p>\n<p>Inheritance is carried out according to the will or according to the law (part 1 of article 1217 of the Civil Code).<\/p>\n<p>Inheritance includes all rights and obligations that belonged to the testator at the time of opening the inheritance and not terminated as a result of his death (part 1 of article 1218 of the Civil code).<\/p>\n<p>We should not forget that you can inherit not only the rights, but also responsibilities!<\/p>\n<p>So, according to article 1231 of the Civil Code:<\/p>\n<ol>\n<li>The obligation to compensate for the property damage (harm) caused by the testator passes to the heir.<\/li>\n<li>The obligation to compensate for moral damage caused by the testator, which was sentenced by the court from the testator during his life, shall pass to the heir.<\/li>\n<li>The obligation to pay the penalty (fine, penalty), awarded by the court to the creditor from the testator during the testator&#8217;s life, shall pass to the heir.<\/li>\n<li>Property and moral damage caused by the testator shall be compensated by the heirs to the extent of the value of movable or immovable property received by them through inheritance.<\/li>\n<\/ol>\n<h2>Procedure for inheritance by will<\/h2>\n<p>A will is a personal disposition of an individual in the case of his or her death (part 1 of article 1233 of the Civil Code).<\/p>\n<p>The testator has many rights to express his or her will in the case of his death. The testator has the right:<\/p>\n<ul>\n<li>to determine the amount of inheritance to be inherited under the will ( Article 1236 of the Civil Code),<\/li>\n<li>to impose other obligations on the heir (Article 1240 of the Civil Code),<\/li>\n<li>to appoint heirs ( Article 1235 of the Civil Code), etc.<\/li>\n<\/ul>\n<p>Thus, according to article 1235 of the Civil Code:<\/p>\n<ol>\n<li>The testator may designate one or more natural persons as his or her heirs, regardless of whether he or she has family relations with these persons, as well as other participants in civil relations.<\/li>\n<li>The testator may deprive any person from among the heirs at law of the right to inherit without stating the reasons. In this case this person cannot receive the right to inherit.<\/li>\n<li>The testator may not deprive the right to inherit from persons who have the right to an obligatory share in the inheritance. The validity of a will with respect to persons entitled to an obligatory share in an inheritance is established for the time of the opening of the inheritance.<\/li>\n<\/ol>\n<p>The testator makes the will in person at the notary, and the notary registers it in the probate registry. The testator may revoke the will, make a new will, and so on. Each new will cancels the previous one.<\/p>\n<h2>How to inherit under the will?<\/h2>\n<p>The procedure for probate inheritance is general: the notary submits an application for acceptance of inheritance, the notary conducts the probate proceedings and issues a certificate of right to inherit six months later. The only thing is to carefully study the content of the will: can the will be declared invalid? does it cover the entire inheritance or only part of it?<\/p>\n<p>According to Part 2 of Art. 1223 of the Civil Code, in the absence of a will, its invalidation, rejection or refusal of the inheritance by the heirs of the will, as well as in case of not all inheritance is included into the will the right to inheritance receive people according to the law.<\/p>\n<h2>Order of inheritance by law<\/h2>\n<p>According to Article 1258 of the Civil Code:<\/p>\n<ol>\n<li>Heirs at law receive the right to inherit one by one.<\/li>\n<li>Each successive line of heirs by the law gets the right to inherit in case of absence of heirs of the previous line, their exclusion from the right to inherit, non-acceptance or refusal to accept the inheritance.<\/li>\n<\/ol>\n<p>According to part 1 of article 1261 of the Civil Code:<\/p>\n<ul>\n<li>Children of the testator, including those conceived during the testator&#8217;s life and born after his death, the spouse who survived him, and parents have the right to inherit by the law in the first place (part 1 of article 1261 of the Civil Code).<\/li>\n<li>Second priority of the inheritance under the law belongs to siblings of the testator, his grandparents both from the father&#8217;s and mother&#8217;s side (part 1 of article 1262 of the Civil Code).<\/li>\n<li>In the third turn the right to inherit according to the law have the uncle and the aunt of the testator (part 1 of article 1263 of the Civil Code).<\/li>\n<li>In the fourth turn the right to inherit according to the law have persons who lived with the testator as a family not less than five years before the opening of the inheritance (part 1 of article 1264 of the Civil Code).<\/li>\n<li>In the fifth order of priority the right to inherit by the law shall have other relatives of the testator up to the sixth degree of kinship inclusive, with relatives of the next degree of kinship shall exclude from the right to inherit the relatives of the next degree of kinship (part 1 of article 1265 of the Civil Code).<\/li>\n<\/ul>\n<p>Grandchildren, great-grandchildren of the testator inherit that share of inheritance which would belong to their mother, father, grandmother, grandfather, if they were alive at the time of opening the inheritance (inheritance by right of representation) (part 1 of article 1266 of the Civil Code).<\/p>\n<p>The inheritance shares of each of the heirs under the law are equal (part 1 of Article 1267 of the Civil Code.<\/p>\n<h2>How to get an inheritance by law?<\/h2>\n<p>The procedure for processing an inheritance by law is general: you submit a notary&#8217;s application for acceptance of inheritance, the notary conducts the inheritance proceedings and issues a certificate of right to inherit six months later.
