header_2_font_size_phone=&#8221;20px&#8221; header_2_font_size_last_edited=&#8221;on|phone&#8221; header_3_font_size_tablet=&#8221;&#8221; header_3_font_size_phone=&#8221;24px&#8221; header_3_font_size_last_edited=&#8221;on|phone&#8221;]<\/p>\n<h2>Procedures and rules for division of marital property in court<\/h2>\n<p>There are two legal regimes for marital property:<\/p>\n<ul>\n<li>property owned by a wife (husband) on the right of personal private ownership,<\/li>\n<li>property belonging to the spouses on the right of common joint ownership.<\/li>\n<\/ul>\n<p>Courts, distinguishing between these two legal regimes and taking into account other circumstances that are not of legal significance, try to resolve this category of cases as fairly as possible.<\/p>\n<p>According to Article 57 of the Family Code:<\/p>\n<ul>\n<li>The personal private property of a wife, husband:<\/li>\n<\/ul>\n<p>&#8211; property acquired by him\/her before marriage;<\/p>\n<p>&#8211; property acquired by him\/her during the marriage, but on the basis of a gift contract or by inheritance;<\/p>\n<p>&#8211; property acquired by him\/her during marriage, but for funds belonging to him\/her personally;<\/p>\n<p>&#8211; housing acquired by him\/her during the marriage as a result of its privatization in accordance with the Law of Ukraine &#8220;On Privatization of the State Housing Fund&#8221;;<\/p>\n<p>&#8211; a land plot acquired by him\/her during the marriage as a result of privatization of a land plot which is in him\/her use, or obtained as a result of privatization of land plots of state and municipal agricultural enterprises, institutions and organizations, or obtained from state and communal land ownership within the norms of free privatization defined by the Land Code of Ukraine.<\/p>\n<ul>\n<li>The personal private property of the wife and husband are items of individual use, including jewelry, even when they were purchased with the joint funds of the spouses.<\/li>\n<li>The personal private property of the wife, husband is the prizes, awards he\/she has received for her personal achievements.<\/li>\n<li>The court may recognize the other spouse&#8217;s right to a share of that award, if it is established that he\/she contributed to its receiving by his\/her actions (running the household, raising children, etc.).<\/li>\n<li>The personal private property of the wife, husband is the funds received as compensation for the loss (damage) of an item belonging to him\/her, as well as compensation for the moral damage caused to him\/her.<\/li>\n<li>The personal private property of a spouse is the insurance sums received by him\/her under compulsory personal insurance, as well as under voluntary personal insurance, if the insurance premiums were paid at the expense of funds that were the personal private property of each of them.<\/li>\n<li>The court may recognize as the personal private property of the spouse, the property acquired by him\/her during their separate residence in connection with the actual termination of the marital relationship.<\/li>\n<li>If money belonging to one of the spouses has been invested in the acquisition of the property in addition to the common funds, the share in that property, according to the amount of the contribution, is his\/her personal private property.<\/li>\n<\/ul>\n<p>In forming legal positions in court, many try, including in an artificial way, to include as much property as possible in the right of personal private property, or to recognize the opponents&#8217; property belonging to them on the right of personal private property as the object of the right of joint ownership.<\/p>\n<p>The property acquired by the spouses during the marriage belongs to the wife and husband on the right of common joint ownership, regardless of the fact that one of them did not have for a good reason (education, housekeeping, child care, illness, etc.) independent earnings (income) (Article 60 of the FC).<\/p>\n<p>By the way, if a woman and a man live as one family, but are not married to each other or in any other marriage, the property acquired by them during their time together belongs to them on the right of common joint ownership, unless otherwise established by a written agreement between them (part 1 of Article 74 of the Family Code).<\/p>\n<p>If the wife and husband, including the ex-marriage, cannot agree on the order of using the common property or on the division of the common property, then sooner or later the dispute will be taken to court.<\/p>\n<p>Before going to court, it is necessary to determine the content of the property to be divided, to predict the prospects for resolution of the court case. Accumulate title documents, conduct an inventory of common property. Pay the court fee. But, most importantly, decide who will represent your interests in court!
