Legal assistance to a witness<\/h1>\n

According to Article 65 of the Criminal Code of Ukraine:<\/p>\n

    \n
  1. A witness is a natural person who knows or may know the circumstances to be proven in criminal proceedings and has been called to testify.<\/li>\n
  2. The following may not be questioned as witnesses:<\/li>\n<\/ol>\n

    1) defender, representative of the victim, civil plaintiff, civil defendant, legalentity in respect of which the proceedings are conducted, legal representative of the victim, civil plaintiff in criminal proceedings – about the circumstances that have become known to them in connection with the performance of the functions of a representative or defender;<\/p>\n

    4) medical workers and other persons who, in connection with the performance of professional or official duties, become aware of an illness, medical examination, check-up and its results, intimate and family aspects of a person’s life – about information that constitutes medical secrecy;<\/p>\n

    5) priests – about information received by them in the confession of believers;<\/p>\n

    6) journalists – on information containing confidential information of professional nature provided on condition of non-disclosure of authorship or source of information;<\/p>\n

    7) professional judges, people’s assessors and jurors – about the circumstances of discussion in the deliberation room of issues that arose during the adoption of a court decision, except in criminal proceedings on the adoption of a judge (judges) of a knowingly unlawful sentence, determination;<\/p>\n

    8) persons who participated in the conclusion and execution of a conciliation agreement in criminal proceedings – about the circumstances that became known to them in connection with their participation in the conclusion and execution of the conciliation agreement;<\/p>\n

    9) persons to whom security measures are applied – according to valid data about their person;<\/p>\n

    10) persons who have information about valid data on persons to whom security measures have been applied – according to these data.<\/p>\n

      \n
    1. Persons specified in items 1-5 of part two of this Article may be released from the obligation to keep professional secrets to the extent specified by the person who entrusted them with such information. Such release shall be made in writing, signed by the person who entrusted the said information.<\/li>\n
    2. Persons with the right of diplomatic immunity may not be questioned as witnesses without their consent, nor may employees of diplomatic missions be questioned without the consent of a representative of the diplomatic institution.<\/li>\n<\/ol>\n

      The investigator, prosecutor, investigative judge, and court before questioning the persons referred to in the first paragraph of this part shall be obliged to explain their right to refuse to testify.<\/p>\n

      According to Article 66 of the Criminal Code of Ukraine:<\/p>\n

        \n
      1. A witness has the right:<\/li>\n<\/ol>\n

        1) to know in connection with what and in what criminal proceedings he is interrogated;<\/p>\n

        2) to have the legal assistance of an advocate, whose authority is confirmed in accordance with the provisions of Article 50 of this Code, while giving testimony and participating in the performance of other procedural actions;<\/p>\n

        3) to refuse to give testimony concerning himself, his close relatives and family members that may become grounds for suspicion or accusation of a criminal offense committed by him, his close relatives or family members, as well as testimony concerning information that, under the provisions of Article 65 of this Code, is not subject to disclosure;<\/p>\n

        4) to give testimony in his native language or another language which he is fluent in, and to have the assistance of an interpreter;<\/p>\n

        5) to use notes and documents when testifying in cases where the testimony relates to any calculations and other information which he finds difficult to keep in his memory;<\/p>\n

        6) to be reimbursed for the expenses associated with the summons to testify;<\/p>\n

        7) to get acquainted with the protocol of interrogation and to petition to make changes, additions and comments to it, as well as to make such additions and comments in one’s own hand;<\/p>\n

        8) petition for security in cases prescribed by law;<\/p>\n

        9) to refuse the interpreter.<\/p>\n

          \n
        1. A witness shall be obliged:<\/li>\n<\/ol>\n

          1) to come when summoned to the investigator, prosecutor, investigating judge or court;<\/p>\n

          2) give truthful testimony during pre-trial investigation and trial;<\/p>\n

          3) not to disclose, without permission of an investigator, prosecutor, or court, information directly related to the essence of criminal proceedings and procedural actions performing (performed) during it, and which became known to a witness in connection with the performance of his duties.<\/p>\n

          3. A person involved in the conduct of procedural actions during a pre-trial investigation as a witness or who witnessed such actions shall, at the request of the investigator or prosecutor, be obliged not to disclose information about the conducted procedural action.<\/p>\n

          According to Article 67 of the Criminal Code of Ukraine:<\/p>\n

            \n
          1. For knowingly giving false testimony to an investigator, prosecutor, investigative judge or court or refusing to testify to an investigator, prosecutor, investigative judge or court, except in cases provided for in this Code, a witness shall bear criminal liability.<\/li>\n
          2. For malicious evasion of appearing before an investigator, prosecutor, investigating judge or court, a witness shall bear the liability established by law.<\/li>\n<\/ol>\n
